Fiber Club Terms of Service

Please read these terms of service ("terms") carefully before using Fiber Club website or app (the "service") operated by Liza and Rommel Rico ("us", "we", "our").

Conditions of Use

We will provide services to you, which are subject to the conditions stated below in this document. Every time you visit fiber.club, use its services or make a purchase, you accept the following conditions.

Digital Content Purchases

License Grant

When you purchase a digital pattern or other digital content from Fiber Club, you receive a perpetual, non-exclusive, non-transferable license to use that content for personal, non-commercial purposes. This license remains valid indefinitely, regardless of changes to the designer's account status.

Patterns you have purchased will remain accessible in your account library even if the original designer deletes their account or removes the pattern from sale. We maintain copies of purchased content to honor your perpetual license rights.

Designer Accounts

Eligibility

To create a designer account, you must be at least 18 years of age and legally able to enter into binding contracts. By registering as a designer, you represent and warrant that you meet these requirements.

License Grant to Buyers

When a buyer purchases your pattern, you grant them a perpetual, non-exclusive, non-transferable license to use that pattern for personal, non-commercial purposes. This license survives any termination or deletion of your designer account.

Content Ownership

You retain full ownership of your original patterns and content. By uploading content to Fiber Club, you grant us a non-exclusive, worldwide license to display, distribute, and promote your patterns on our platform. This license terminates when you delete your account, except as necessary to fulfill perpetual licenses granted to buyers.

Designer Account Deletion

Grace Period

When you request deletion of your designer account, a 30-day grace period begins. Your shop will be hidden from public view immediately, but your account remains active during this period. You may cancel the deletion request at any time during the grace period.

We will notify customers who have purchased your patterns via email at the following intervals:

After the 30-day grace period, your personal information will be removed from our systems. However, patterns that have been purchased will be preserved and remain accessible to buyers who hold perpetual licenses. Designer attribution will be maintained on preserved patterns.

Earnings and Payouts

You must withdraw any outstanding earnings before your account is deleted. After the 30-day grace period, any remaining balance will be forfeited after 90 days. We recommend initiating payout requests before requesting account deletion.

Reinstatement

Once your designer account is deleted, it cannot be restored. If you wish to sell patterns on Fiber Club again, you must create a new account and reapply as a designer.

Account Termination

If you are an owner of an account on this website or app, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password. You may also be held accountable for users you bring onto the website or app who violate our terms of service.

Termination by You

You may delete your account at any time through the app settings. For regular user accounts, deletion is immediate. For designer accounts, a 30-day grace period applies as described in the Designer Account Deletion section above.

We reserve the right to suspend or terminate your account at our sole discretion for any reason, including but not limited to:

Effect of Termination

Upon termination, you will lose access to your account and any associated content. However, patterns you have purchased will remain accessible under your perpetual license. If you are a designer, the Designer Account Deletion process applies, and your patterns will be preserved for existing buyers.

Copyright

Content published on this website and/or app (digital downloads, images, texts, graphics, logos) is the property of Fiber Club and/or its content creators and protected by international copyright laws.

License and Site Access

We grant you a limited license to access and make personal use of this website and its app. You are not allowed to download or modify it.

Comments, Reviews, and Emails

Visitors may post content as long as it is not obscene, illegal, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or injurious in any other way to third parties. We also will not tolerate Unacceptable behaviors or harassment as outlined below.

We reserve all rights to remove and/or edit such content. When you post your content, you grant Fiber Club non-exclusive, royalty-free and irrevocable right to use, reproduce, publish, modify such content throughout the world in any media.

Communications

All communication is done electronically. If you subscribe to the Fiber Club newsletter, you will receive regular emails from us. Every time you communicate with us through email, social media, and/or form fill, you are consenting to receive communications from us. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing.

Applicable Law

By visiting this site or using our app, you agree that the laws of the United States, without regard to principles of conflict laws, will govern these terms of service, or any dispute of any sort that might come between Fiber Club and you.

Disputes

Any dispute related in any way to your visit to this website/app, or products you purchase from us shall be arbitrated by state (California) or federal court (United States) and you consent to exclusive jurisdiction and venue of such courts.
